1. Service Description
Altly provides AI-generated alt text descriptions for images. Users may submit images through our integrations or API, where the images are processed by our software to generate alt text. To provide this Service, we leverage third-party tools and services as part of the image processing and generation workflow.
2. User Responsibilities
- Account Requirements: To use the Service, you must create an account and provide accurate, complete, and up-to-date information.
- Use of Service: You agree to use the Service only for lawful purposes and in compliance with all applicable laws, rules, and regulations.
- Submission of Images: You represent and warrant that you have the rights and permissions necessary to upload or submit images to the Service. You are responsible for ensuring that the images do not infringe on any third-party intellectual property or privacy rights.
3. Image Handling and Storage
- Temporary Storage with Third-Party Providers: Images submitted to Altly may be temporarily stored on third-party systems as part of the image processing workflow. This temporary storage is necessary to facilitate the generation of alt text. Images stored on third-party systems are deleted within 30 to 60 days, or sooner as needed.
- Permanent Storage on Altly: Images are stored permanently on Altly’s platform to maintain a historical usage log for your account. This log provides you with access to a record of your submitted images, their processing history, and the alt text that was generated for each image. This transparency allows you to track your usage and review previous results.
- Data Security: We take reasonable steps to protect the security of images submitted to our platform. While we employ industry-standard measures to safeguard your data, no method of transmission over the internet or electronic storage is 100% secure.
4. Third-Party Services
Altly utilizes third-party tools and services to assist with processing and generating alt text. While we strive to work with reputable providers, Altly does not guarantee the performance or security of these third-party services. By using Altly, you acknowledge and agree that third-party services are used as part of the image processing workflow.
5. Intellectual Property
- Ownership of Images: You retain ownership of all images you submit to the Service. By submitting images, you grant Altly a non-exclusive, worldwide, royalty-free license to process and store these images for the purpose of generating alt text as part of the Service.
- Ownership of Generated Content: The alt text generated by our AI is provided for your use. You may use, distribute, or modify the alt text as you see fit, subject to these Terms.
- Intellectual Property Rights: Altly’s software, technology, and all related intellectual property are owned by Altly and are protected by copyright, trademark, and other intellectual property laws.
6. User Conduct
You agree not to:
- Use the Service to submit images containing unlawful, obscene, defamatory, or harmful content.
- Reverse-engineer, decompile, or disassemble any part of the Altly platform.
- Bypass any security measures or interfere with the proper functioning of the Service.
Violation of these rules may result in the suspension or termination of your access to the Service.
7. Payment and Fees
Access to Altly’s Service may be subject to subscription fees or usage-based fees. Payment terms, billing schedules, and other relevant details will be disclosed to you at the time of purchase or subscription.
8. Privacy Policy
Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to the collection and use of this information in accordance with our Privacy Policy.
9. Termination
We may terminate or suspend your access to the Service if you violate these Terms or if we believe your actions may cause harm to other users, Altly, or third parties. Upon termination, your right to use the Service will immediately cease.
10. Disclaimers and Limitation of Liability
- Disclaimer of Warranties: The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: To the fullest extent permitted by law, Altly and its affiliates, directors, employees, and third-party partners are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service.
11. Indemnification
You agree to indemnify and hold Altly, its affiliates, and employees harmless from any claims, damages, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Changes to the Terms
Altly may update these Terms from time to time. If changes are made, we will notify users by posting the updated Terms on our website or by other reasonable means. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through arbitration in accordance with the rules of the American Arbitration Association (AAA). Both parties waive the right to a trial by jury.
